1. Terms

By accessing this website and the Amber Hour phone application (hereby known as Amber Hour’s ‘platforms’), you are agreeing to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing Amber Hour platforms. The materials contained in these platforms are protected by applicable copyright and trademark law.

2. Use License

(a) Permission is granted to temporarily download one copy of the materials (information or software) on Amber Hour's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

(i) modify or copy the materials;

(ii) use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

(iii) attempt to decompile or reverse engineer any software contained on Amber Hour's platforms;

(iv) remove any copyright or other proprietary notations from the materials; or

(v) transfer the materials to another person or "mirror" the materials on any other server.

(b) This license shall automatically terminate if you violate any of these restrictions and may be terminated by Amber Hour at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Rules of Membership

(a) Amber Hour membership and benefits are non-transferable. Unless specifically stated, benefits apply to the Member only and may not be applied to any other individual.

(b) Members may redeem their drink credits at any listed partner venues (known as ‘Crafters’) for a complimentary drink (schooner, mixed drink or equivalent) from the venues core range of beverages. Some restrictions may apply. Please visit the individual Crafter’s profile page for additional information about a specific venue.

(c) Amber Hour Crafters are subject to change without notice. Active Crafters are those appearing within the ‘Explore’ tab in the phone app.

(d) Members may redeem one (1) drink credit per venue, per 30-day period.

(e) Members must wait a minimum of two (2) hours between redemptions.

(f) The official Amber Hour phone app identifies you as a Member and entitled to membership benefits. Members may be asked to present a legal form of identification when ordering alcoholic beverages

(g) Additional Crafter benefits and promotions (ie – 15% off takeaways) will contain specific Terms & Conditions that will be detailed within the phone app.

(h) You will only be able to claim drink credits by accessing the phone app while connected to the internet and logged into your Member account.

(i) Members may only have one active membership. Additional memberships attributed to the same Member will be cancelled without refund.

(j) Amber Hour reserves the right to change the terms and benefits of its membership at any time.

(k) You must be at least 18 years old to join Amber Hour.

(l) Venue staff have the right to refuse service (including the redemption of drink credits or other venue promotions, discounts or benefits) to Members or those affiliated with Members in accordance with the Responsible Service of Alcohol regulations.

4. Membership Fees

Amber Hour Premium Memberships are handled through your Google or Apple subscriptions. When your membership is due for renewal, your payment method currently associated with your Google Play or Apple Play account will be charged. If your account has been closed or your payment method is otherwise invalid, your membership may not renew and will be terminated until a valid payment method is in place.

Until you cancel, billing will continue according to the cycle stated at the time of your purchase.

5. Cancellation & Refund Policy

You can cancel your membership through your Google Play or Apple Play subscriptions.

Upon cancellation of an active membership, all Member benefits will cease immediately. This includes the ability to redeem drink credits at Crafters. Amber Hour is not under obligation to offer refunds under any circumstances.

6. Discounts

Members are entitled to utilise individual promotion/discount codes one time only. If members choose to apply a code, cancel their membership before renewal, and sign up with the same code on the same membership, they risk cancellation of that membership without refund.

7. Agreement to Rules of User Conduct

Amber Hour platforms allow for users to post comments on certain stories, articles or venues. You agree to abide by Amber Hour’s Rules of User Conduct, including but not limited to, agreeing not to use these platforms for any unlawful purpose.

By posting information on these platforms, you agree that you will not upload, post, or otherwise distribute or facilitate distribution of any content – including text, communications, software, images, sounds, data, or other information that:

(a) Is unlawful, threatening, abusive, harassing, defamatory, libellous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), uses vulgar language in the submission of any text or otherwise violates Amber Hour’s rules or policies or these Rules of User Conduct;

(b) Victimises, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;

(c) Constitutes unauthorised or unsolicited advertising, junk or bulk e-mail (also known as “Spamming”), chain letters, any other form of unauthorised solicitation, or any form of lottery or gambling;

(d) Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of any third party; or

(e) Harvests or collects information about the users or members of this site or use such information for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic e-mail or communications.

You further agree that you will not knowingly solicit or collect personal information from a minor (anyone under 18 years old). Personal information includes but is not limited to name, address, phone number or name of their school. Amber Hour does not pre-screen, monitor, or edit the content posted by users of these platforms. However, Amber Hour and its agents have the right at their sole discretion to remove any content that, in Amber Hour’s judgment, does not comply with the Rules of User Conduct or is otherwise harmful, objectionable, or inaccurate. Amber Hour is not responsible for any failure or delay in removing such content.

8. Disclaimer

The materials on Amber Hour's platforms are provided as is. Amber Hour makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Amber Hour does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its platforms or otherwise relating to such materials or on any linked sites.

9. Limitations

In no event shall Amber Hour or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Amber Hour's platforms, even if Amber Hour or an Amber Hour authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

10. Revisions and Errata

The materials appearing on Amber Hour's platforms could include technical, typographical, or photographic errors. Amber Hour does not warrant that any of the materials on its platforms are accurate, complete, or current. Amber Hour may make changes to the materials contained on its platforms at any time without notice. Amber Hour does not, however, make any commitment to update the materials.

11. Links

Amber Hour has not reviewed all of the sites linked to its platforms and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Amber Hour of the site. Use of any such linked website is at the user's own risk.

12. Site Terms of Use Modifications

Amber Hour may revise these terms of use for its platforms at any time without notice. By using Amber Hour platforms, you are agreeing to be bound by the then current version of these Terms of Service.

13. Right of Revocation

Amber Hour reserves the right to revoke any membership, without refund, for refusal to observe the Terms of Service and/or Rules of Membership.

14. Governing Law

Any claim relating to Amber Hour's platforms shall be governed by the laws of Australia without regard to its conflict of law provisions.

15. International Use

Amber Hour makes no representation that materials on its platforms are appropriate or available for use in locations outside Australia and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
